These Consignment Terms & Conditions ("Terms") apply to all items submitted to Silk Sneaker for consignment and sale.

By submitting an item for consideration and, if accepted, sending the item to Silk Sneaker, you confirm that you have read and agreed to these Terms.

1. CONSIGNMENT

Silk Sneaker accepts selected vintage and fashion pieces for consignment and resale.

Consignment means that the consignor retains ownership of the item until it is sold to a customer.

Submitting an item does not guarantee that Silk Sneaker will accept, list, or sell the item. Silk Sneaker reserves the right to decline any submission at its discretion.

 

2. OWNERSHIP

The consignor must be the legal owner of the item or have full authority from the owner to consign it.

Ownership remains with the consignor until the item is successfully sold to a customer.

The consignor confirms that the item is not stolen, counterfeit, unlawfully obtained, subject to a lien, or otherwise subject to another person's ownership claim.

 

3. AUTHENTICITY

All items submitted must be authentic.

The consignor is responsible for providing accurate information about the item, including its brand, age, condition, provenance, alterations, repairs, defects, and authenticity.

Silk Sneaker may request additional photographs, receipts, authentication documentation, or other information before accepting an item.

Silk Sneaker reserves the right to reject an item if we have concerns regarding its authenticity, condition, provenance, or suitability for our collection.

If an item is subsequently found to be counterfeit or unlawfully obtained, Silk Sneaker may remove it from sale and take any action reasonably necessary in accordance with applicable law.

 

4. SHIPPING TO SILK SNEAKER

The consignor is responsible for the cost of shipping an accepted item to Silk Sneaker.

Items should be securely packaged and sent using a trackable shipping service.

The consignor should retain proof of shipment and tracking information until Silk Sneaker confirms receipt.

Silk Sneaker is not responsible for loss or damage occurring during transit before the item has been received by Silk Sneaker.

 

5. INSPECTION AND CONDITION

Once received, each item will be inspected by Silk Sneaker.

The condition of the item may be documented through photographs and other records at the time of receipt.

If the item's actual condition, authenticity, or characteristics materially differ from the information provided during submission, Silk Sneaker may decline the item.

Any significant flaws, stains, damage, alterations, repairs, or missing components should be disclosed before the item is shipped.

 

6. PRICING

Silk Sneaker will propose the initial selling price based on factors including the item's brand, rarity, condition, provenance, market demand, comparable prices, and overall desirability.

The selling price will be agreed with the consignor before the item is listed.

Silk Sneaker may recommend a price adjustment during the consignment period if necessary to facilitate a sale.

Any material change to the agreed selling price will be communicated to the consignor before the revised price is applied.

7. CONSIGNMENT PERIOD

The standard consignment period is 90 days from the date the item is accepted and listed for sale.

During this period, Silk Sneaker may photograph, style, list, advertise, promote, and otherwise market the item through our website, social media, and other marketing channels.

If the item has not sold at the end of the 90-day period, the consignor may:

request that the item be returned; or

agree to extend the consignment period.

 

8. UNSOLD ITEMS AND RETURN SHIPPING

If an item remains unsold at the end of the consignment period, Silk Sneaker will contact the consignor to discuss whether the item should be returned or the consignment extended.

The consignor is responsible for all costs associated with returning an unsold item.

This includes applicable courier, postage, insurance, customs, duties, and other delivery-related charges.

Silk Sneaker will arrange the return using a trackable shipping service once the required return shipping costs and information have been provided.

 

9. EARLY WITHDRAWAL

A consignor may request the return of an item before the end of the 90-day consignment period.

The request will be subject to reasonable processing time.

The consignor is responsible for the cost of returning an item following an early withdrawal request.

Silk Sneaker may temporarily delay a return where an item is subject to a pending customer transaction or other legitimate operational requirement.

 

10. COMMISSION

For each successfully completed sale, Silk Sneaker will retain a 30% commission of the final sale price.

The consignor will receive the remaining 70% of the final sale price.

For example, if an item sells for $1,000:

Silk Sneaker receives $300

The consignor receives $700

The commission is calculated on the final agreed selling price of the item, after any agreed discount or price adjustment.

Separately charged shipping fees are not included in the sale price for purposes of calculating the commission.

 

11. PAYMENT TO THE CONSIGNOR

The consignor's share will become payable after the sale has been successfully completed and any applicable customer return, cancellation, refund, or payment-reversal period has passed.

Silk Sneaker will make payment within 14 business days after the payment becomes due.

Payment will be made using the payment method agreed between Silk Sneaker and the consignor.

The consignor is responsible for providing accurate payment information.

 

12. CUSTOMER RETURNS AND REFUNDS

If a customer returns an item in accordance with Silk Sneaker's applicable return policy, the sale will be treated as cancelled.

If the consignor has not yet been paid, no payment will be due for the cancelled transaction.

If the consignor has already been paid and the transaction is subsequently refunded, reversed, or charged back, Silk Sneaker may recover the corresponding amount from the consignor or offset it against future amounts payable, subject to applicable law.

 

13. LOSS OR DAMAGE

Silk Sneaker will take reasonable care of accepted items while they are in our possession.

Silk Sneaker will be responsible, subject to applicable law, for loss or damage caused by Silk Sneaker's negligence or wilful misconduct while an item is in our possession.

The consignor should provide accurate information regarding the item's value and condition when submitting the item.

For particularly high-value items, Silk Sneaker may request additional documentation or agree a declared value before accepting the item.

 

14. PHOTOGRAPHY AND MARKETING

By consigning an item, the consignor authorizes Silk Sneaker to photograph, style, describe, advertise, promote, and display the item for the purpose of marketing and selling it.

Silk Sneaker may determine how an accepted item is photographed, styled, described, and presented.

Silk Sneaker may use photographs and original marketing materials created by Silk Sneaker in connection with the sale and promotion of the item.

 

15. UNCLAIMED ITEMS

If an item remains unsold and the consignor does not respond to Silk Sneaker's reasonable attempts to arrange its return or continued consignment, Silk Sneaker will make further reasonable attempts to contact the consignor using the contact information provided.

Silk Sneaker will not automatically take ownership of an unclaimed item solely because the consignor has failed to respond.

Any further action concerning an unclaimed item will be taken in accordance with applicable Hong Kong law.

 

16. PERSONAL DATA

Silk Sneaker collects personal information provided through the consignment process for purposes including reviewing submissions, communicating with consignors, managing consignments, arranging shipping, processing payments, and completing sales.

Personal data will be handled in accordance with applicable Hong Kong privacy laws, including the Personal Data (Privacy) Ordinance (Cap. 486).

Silk Sneaker will collect and use personal data only for purposes related to the consignment service and other purposes disclosed to the consignor.

The Hong Kong Privacy Commissioner states that personal-data collection should be lawful and fair, necessary and not excessive, and that people should be informed about the purposes of collection and the classes of persons to whom data may be transferred.

 

17. RECORDS

Silk Sneaker will maintain reasonable records relating to consigned items, including information concerning the consignor, item description, sale price, and payment.

Hong Kong's Inland Revenue Department requires businesses dealing in goods to keep records sufficient to verify the goods, sellers, buyers, quantities and values.

 

18. CHANGES TO THESE TERMS

Silk Sneaker may update these Terms from time to time.

The Terms applicable to an item will be those in effect and agreed when the item is accepted for consignment, unless otherwise agreed or required by applicable law.

 

19. GOVERNING LAW

These Terms and each consignment arrangement between Silk Sneaker and the consignor shall be governed by and interpreted in accordance with the laws of the Hong Kong Special Administrative Region.

Subject to any mandatory rights or remedies available under applicable law, the parties submit to the jurisdiction of the courts of the Hong Kong Special Administrative Region.

CONSIGNOR ACKNOWLEDGEMENT

By submitting an item to Silk Sneaker and sending an accepted item for consignment, the consignor confirms that:

they have read and understood these Consignment Terms & Conditions;

they are the lawful owner of the item or are authorized to consign it;

the information provided about the item is accurate;

they understand that the standard consignment period is 90 days;

they understand that they are responsible for shipping the item to Silk Sneaker;

they understand that they are responsible for return shipping if the item is returned;

they understand that Silk Sneaker retains 30% of the final sale price and the consignor receives 70%; and

they agree to these Terms.
